No person shall obstruct or encroach upon the highways with fences, buildings, constructions or otherwise, and whoever does so shall be guilty of a misdemeanor and upon conviction punished with a fine of not less than three hundred dollars ($300) nor more than five hundred dollars ($500), the penalty of restitution, or both penalties at the discretion of the court. Each day the encroachment or obstruction remains shall be deemed a separate and independent offense.
