No person shall obstruct or encroach upon the highways with fences, buildings, constructions or otherwise, and whoever does so shall be guilty of a misdemeanor and upon conviction punished with a fine of not less than three hundred dollars ($300) nor more than five hundred dollars ($500), the penalty of restitution, or both penalties at the discretion of the court. Each day the encroachment or obstruction remains shall be deemed a separate and independent offense. The Department is hereby authorized to immediately remove whatever constitutes the obstruction or invasion should it affect the traffic safety.\nHistory —May 30, 1973, No. 54, p. 135, § 6-05; Oct. 12, 1997, No. 126, § 1.
