In any construction of a public work at any of the branches of Government of the Commonwealth of Puerto Rico, public corporations and municipalities in which heavy construction or agricultural equipment units are used, the owner (the agency, instrumentality or municipality) shall require that the general contractors, the subcontractors and the suppliers submit evidence of the registration and ownership of each unit and that they provide proof of compliance with all the provisions of this chapter.\nIn the event the general contractor or a subcontractor or supplier is not fully complying with all the provisions of this chapter or is unable to prove so, the owner shall be authorized to withhold payment of any invoice or certification under the construction contract, until it is proven that said noncompliance has been remedied.\nHistory —Sept. 30, 2004, No. 531, § 5.01, eff. 6 months after Sept. 30, 2004.
