The procedures or tests described in §§ 5201—5209 of this title may be applied to any person on foot, on horseback, or in a vehicle or motor vehicle, or on any other means of transportation, on any public thoroughfare of Puerto Rico, or who travels thereon while in a drunken condition or under the influence of drugs or controlled substances, and who endangers his own safety or the safety of the persons who travel on the public thoroughfares of Puerto Rico. If said person causes a traffic accident as a result of such condition, said person shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine that shall not exceed five hundred dollars ($500) or by imprisonment for a term of not more than six (6) months, or both penalties, at the discretion of the court. Provided, that the provisions described in §§ 5201—5209 of this title may also be applied.\nThe procedures or tests described in §§ 5201—5209 of this title may be applied to any person operating an all-terrain vehicle on any of the public thoroughfares of Puerto Rico or who travels thereon while in a drunken condition or under the influence of drugs or controlled substances.
