The Office of the Commissioner of Financial Institutions and the Department of Consumer Affairs shall have jurisdiction over the claims made by consumers regarding credit repair agencies.The Department of Consumer Affairs, created pursuant to §§ 341 et seq. of Title 3, shall have jurisdiction over claims filed by consumers regarding credit repair agency advertising campaigns promoting unreal and deceitful offers that are prejudicial to consumers.Any consumer may file a claim at the Office of the Commissioner of Financial Institutions to defend the rights granted in this chapter or against any breach of contract by a credit repair agency.Moreover, any consumer may file a judicial action in any competent court to demand compensation for damages or for a specific breach of contract, or both remedies.
