The Commonwealth Elections Commission shall maintain all the ballots and tally sheets corresponding to the Referendum for a term of ninety (90) days as of the certification of the returns, after which they shall be destroyed, unless there is a judicial recourse pending, in which case they shall be kept until a final and binding judgment is delivered.
