No election for an elective public office shall be carried out if, before a primary, a vacancy arises which makes the number of aspirants equal to or less than the number of offices to which a political party is entitled to nominate a candidate. However, if within sixty (60) days before a primary is held, a vacancy should arise which does not make the number of aspirants equal to or less than the number of offices to which a political party is entitled to nominate a candidate, the name of the aspirant shall appear on the ballot and the votes polled by him/her shall not be counted for the purposes of said primary.\nHistory —June 1, 2011, No. 78, § 8.002.
