Whenever the use of a detergent that does not comply with the provisions of this chapter that is not among those permitted in subsection (c) of § 168a of this title is necessary, the person who manufactured, imported, distributed, sold, or used such laundry detergent in Puerto Rico shall apply for a dispensation for approval by the Department. The applicant for such dispensation shall prove to the satisfaction of the Department that the proposed use is justified and that there is no other reasonable alternative to such use. Said dispensation shall be valid for up to one (1) year and may be extended by the Department if the petitioner proves the need thereof. History —July 14, 2009, No. 38, § 5, eff. Jan. 1, 2010.
