Any person not exempted from obtaining a license, and who without obtaining the same and under misrepresentation, uses any means to issue credit cards or to offer or arrange for the obtaining thereof in exchange for money or other goods, shall be guilty of a felony and punished by a fine not greater than ten thousand dollars ($10,000) and not under five thousand dollars ($5,000), or by imprisonment for a fixed term of ten (10) years, which could be increased up to a maximum of fifteen (15) years should there be aggravating circumstances, or reduced to a minimum of five (5) years should there be extenuating circumstances, or by both penalties, at the discretion of the court.
