The provisions of this chapter shall not be applicable to:(1) Persons holding a public office or position of any nature, for compensation or not, in the Government of the Commonwealth of Puerto Rico, or in the federal government, or in the municipal governments, agencies, instrumentalities, and public corporations or political subdivisions thereof, who are engaged in the task of fumigation in the discharge of their official duties.(2) Owners or legal holders of lands, buildings and structures, who perform fumigation tasks with economic poisons at their properties, if and when such fumigations do not affect third persons. Persons herein excluded shall be responsible for the adoption of all possible control and safety measures to avoid injuring health, property, animal and vegetable life, and guarantee public safety.
