The fact that no interest or charge has been fixed in an obligation, contract or agreement, or that the interest or charge set in said obligation, contract or agreement is at an equal or lower rate than that fixed by law or regulation shall not be conclusive evidence of the rate of interest or charge fixed and evidence on the circumstances under which the contract, obligation or agreement was made can be admitted to prove the illegality of the interest or charge really demanded or received.
