(a) In all cases in which it is necessary to ensure the payment of the sales tax established by the provisions of this part, the Secretary may require a cash deposit, a bond, or any other security as a condition for a person to obtain or retain a certificate as a registered merchant under this part. Said bond shall be in the manner and for the amount the Secretary may deem appropriate under the circumstances.(b) Any person who fails to make such a cash deposit, post a bond or any other security as provided by subsection (a) of this section, shall not be entitled to obtain or retain a certificate of registration under this part, and the Secretary of Justice is hereby empowered to initiate the corresponding legal proceedings when so required by the Secretary in order to prevent the person from doing business, subject to the provisions of this part, until the cash deposit has been made or the bond or other security has been posted with the Secretary.
