The court may waive jurisdiction in the absence of a minor, provided the requirements listed in this chapter are met after a hearing is conducted in which the minor is represented by counsel, when the following circumstances concur:\n(1) That on the date of the commission of the deed he has attained the age of fourteen (14) years.\n(2) That he has fled the jurisdiction.\n(3) That sufficient measures have been taken in the jurisdiction to locate him and these have been unsuccessful.\nIn case of a mandatory waiver of jurisdiction, the court may do so in absentia when the above stated circumstances concur, the minor has fled the jurisdiction and the measures taken to locate him have been unsuccessful.\nHistory —July 9, 1986, No. 88, p. 276, § 16, eff. 180 days after July 9, 1986.
