In the appointment of such administrator the Court of First Instance shall prefer the husband or wife of the absentee to his presumptive heirs; the presumptive heirs to other relations; said relations to strangers; and his creditors to those persons not otherwise interested, provided the said creditors are in the full possession of their civil rights and are of good reputation.
