If different persons have designated a tutor for the same minor or incapacitated person, the office shall be determined in the following order:(1) The one designated by the parent that last exercised parental authority (patria potestas).(2) The one named by the nonrelated person that may have instituted the minor or incapacitated person as heir, if the amount of the estate is of importance.(3) The one designated by the person having a charge of importance.If, there is more than one tutor in either of the subsections (2) and (3) of this section, the court will decide who shall have preference.
