The owner of the land who shall make thereon, by himself or through another person, plantings, constructions or works, with material belonging to another person, is bound to pay their value; and if he has acted in bad faith, he shall also be obliged to pay an indemnity for damages and injuries caused thereby. The owner of the materials shall have the right to remove them only in case he can do so without injury to the work constructed, or when by so doing the plantings, constructions or works are not destroyed.\nHistory —Civil Code, 1930, § 296.
