Any condo hotel program existing prior to the effective date of this act shall continue to exist and operate pursuant to the provisions of §§ 681—685 of Title 23, unless such condo hotels decide to abide by the new condo hotel regime under this chapter, for which they shall follow the procedures to carry out such action established in this chapter. Likewise, this chapter shall not impair the constitution of new condo hotel programs under the Condominiums’ Act. Properties covered under a horizontal-property regime intended for residences whose owners agree to establish a condo hotel may do so, whether under the Condominiums’ Act or under this chapter, following the procedures established by said statutes for changes of use or regime.\nHistory —Aug. 12, 2008, No. 249, § 10; Dec. 16, 2009, No. 178, § 30; June 24, 2010, No. 67, § 30.
