Natural or cultivated fruits ungathered at the time the usufruct begins, belong to the usufructuary.\nThose ungathered at the time the usufruct terminates, belong to the owner.\nIn the preceding cases the usufructuary, at the beginning of the usufruct, is not bound to refund to the owner any expenses incurred; but at the termination of the usufruct, the owner is bound to refund, from the proceeds of the ungathered products, the ordinary cost of cultivation, sowing and other expenses of the same nature incurred by the usufructuary.\nThe provisions of this section do not prejudice the rights of any third person acquired either at the beginning or at the end of the usufruct.\nHistory —Civil Code, 1930, § 401.
