When the usufruct includes things which, without being consumed, gradually deteriorate through use, the usufructuary shall have the right to make use thereof, in accordance with the purpose they are intended for, and shall not be obliged to return them at the termination of the usufruct, except in the condition in which they may be; but he shall be obliged to indemnify the owner for whatever deterioration such things may have suffered by reason of deceit or neglect on his part.\nHistory —Civil Code, 1930, § 410.
