If for the diversion or taking of waters from a river or brook, or for the use of other continuous or discontinuous streams it be necessary to construct a dam, and the person who is to construct the same is not the owner of the banks or land upon which he may have to support it, he may establish the servitude for the abutment of the dam by previously paying a proper indemnity.\nHistory —Civil Code, 1930, § 490.
