If the owner of the servient tenement has bound himself at the time of establishing the servitude to defray the cost of the works required for the use and preservation thereof, he may free himself from this obligation by abandoning his estate to the owner of the dominant tenement.\nHistory —Civil Code, 1930, § 535.
