In the case referred to in the first paragraph of the preceding section the donor shall have a right to exact from the donee the value of the property alienated, which he cannot recover from the third persons, or the amount for which they have been mortgaged.\nFor the appraisal of the value of such property the time the gift was bestowed shall be taken into consideration.\nHistory —Civil Code, 1930, § 592.
