If the heirs or legatees do not wish to make use of the rights granted them in the foregoing section, any of them who did not have such right may exercise it; should he not wish to do so, the estate shall be sold at public auction at the instance of any of the persons interested.\nHistory —Civil Code, 1930, § 750.
