The division made by the testator cannot be impugned by reason of lesion excepting in the cases in which it may injure the legal portion of the heirs by force of law, or when it may appear, or it may be reasonably presumed, that the will of the testator was otherwise.\nHistory —Civil Code, 1930, § 1028.
