In obligations to give, the payment made by a person not having the free disposal of the thing due, and capacity to convey it, shall not be valid.\nHowever, if the payment should have consisted in a sum of money or in a thing perishable, no action can be brought against the creditor who may have spent or consumed it in good faith.\nHistory —Civil Code, 1930, § 1114.
