A husband and wife may request the separation of marital property, and it shall be decreed, when the spouse of the petitioner has been declared missing, or has given grounds for divorce.\nFor the separation to be awarded, it shall be sufficient to present the final decree against the guilty or absent spouse in any of the stated cases.\nHistory —Civil Code, 1930, § 1328; Jan. 10, 1998, No. 17, § 12.
