From the provisions of the foregoing section are excepted the assignments or sales made:\n(1) To a coheir or co-owner of the right assigned.\n(2) To a creditor in payment of his credit.\n(3) To the possessor of an estate, subject to the right in litigation which has been assigned.\nHistory —Civil Code, 1930, § 1426.
