In alienations for a valuable consideration of emphyteutic estates, laudemio shall be paid to the legal owner only when it has been expressly stipulated in the contract of emphyteusis.\nIf, when it has been stipulated, a fixed sum has not been specified, it shall consist of two (2) percent of the price of the alienation.\nIn emphyteusis prior to the promulgation of this Code, which may be subject to the payment of laudemio, even though it should not have been stipulated, this prestation shall continue in the usual manner, but it shall not exceed two (2) percent of the price of the alienation, unless a higher one has been expressly agreed upon.\nHistory —Civil Code, 1930, § 1536.
