In order that the partnership may be liable to a third person for the acts of one of the partners, it is necessary:\n(1) That the partner should have acted as such for the account of the partnership.\n(2) That he should have the power to bind the partnership by virtue of an express or implied authority.\n(3) That he may have acted within the limits of his power or authority.\nHistory —Civil Code, 1930, § 1588.
