This application cannot take place:\n(1) If the surety has expressly renounced it.\n(2) If he has jointly bound himself with the debtor.\n(3) In case of bankruptcy of the debtor.\n(4) When the debtor cannot be judicially sued within Puerto Rico.\nHistory —Civil Code, 1930, § 1730.
