Any person who sells, gives, delivers, or distributes cigars, cigarettes, electronic cigarettes or e-cigarettes, or any tobacco preparation, and any kind of material, regardless of what it is made of, that may be used for rolling any kind of shredded tobacco for manufacturing cigarettes, cigars, or flavored cigarettes, as these are defined by §§ 1040-1043 of Title 23, to minors under the age of eighteen (18), shall be guilty of a misdemeanor and, upon conviction, punished by a fine which shall not exceed five thousand dollars ($5,000) or imprisonment for a term which shall not exceed six (6) months.
