If any act or omission were declared to be a crime and no proper punishment were established, such act or omission shall be punishable as a misdemeanor.\nIf any act or omission is declared to be a felony and no proper punishment is established, the sentence to be imposed shall be that of a fourth degree felony.\nHistory —June 18, 2004, No. 149, § 17, eff.
