A person shall not be prosecuted if, at the time of the commission of the act, he/she, as a result of mental disease or defect, was unable to understand the criminality of the act or to conduct him/herself pursuant to the mandate of law.\nThe term 'mental disease' or 'defect' does not include an abnormality manifested only as repeated criminal or antisocial conduct.\nHistory —June 18, 2004, No. 149, § 39, eff.
