Any person who, due to negligence, causes bodily injury requiring hospitalization or prolonged treatment, or which causes permanent damage or mayhem to another person shall incur a misdemeanor, but shall be punished with the penalty for a fourth degree felony.\nHistory —June 18, 2004, No. 149, § 124, eff.
