Any married person who has sexual intercourse with a person other than his/her spouse shall incur a misdemeanor.\nThe prosecution for the crime of adultery shall commence within one year after the crime is committed or from the time it became known to the plaintiff.\nIf the crime of adultery is committed between a married woman and an unmarried man, or a married man and an unmarried woman, the unmarried man or the unmarried woman shall have committed adultery.\nHistory —June 18, 2004, No. 149, § 130, eff.
