Any person who without the right to do so deprives a father, mother or any other person of the legal custody of a minor or a person with disabilities shall incur a misdemeanor.\nIt shall be considered as an aggravated crime and a fourth degree felony when any of the following circumstances concurs:\n(a) If the minor is taken out of the jurisdiction of the Commonwealth of Puerto Rico.\n(b) If the non-custodial father or mother residing outside of Puerto Rico retains the minor when he/she should return the minor to the home of the parent with legal custody.\nHistory —June 18, 2004, No. 149, § 135, eff.
