Any person who knowingly, as a condition for the sale, distribution, consignment or delivery for resale of any newspaper, magazine, book, publication or otherwise any merchandise that requires the buyer or consignee to receive any obscene or child pornography material, or who denies, revokes or threatens to deny or revoke a franchise, or who imposes a monetary punishment or of any other sort because such a person refuses to accept said material, or because of the return of said material, shall incur a misdemeanor.\nHistory —June 18, 2004, No. 149, § 162, eff.
