Any public employee or officer who without legal authority and for illegal purposes prepares, maintains or preserves a file, blacklist, manual, list, or index, or compiles information and documents containing names and information on persons, groups and organizations solely and exclusively due to religious or labor beliefs or ideals, or for reasons of race, color, sex, or physical or mental health conditions, without said persons, groups or entities being connected to the commission or attempt to commit a crime, or for purposes of discriminating in the obtainment of or permanence in employment shall incur a fourth degree felony.\nHistory —June 18, 2004, No. 149, § 178, eff.
