Any person who without legal justification or without a legitimate investigative purpose uses electronic or digital video equipment, with or without audio, to conduct secret surveillance in private places in which persons are under the expectation of privacy shall incur a fourth degree felony.\nHistory —June 18, 2004, No. 149, § 179, eff.
