Any person who unlawfully takes personal property belonging to another in the immediate presence of said person and against his/her will by means of force or intimidation shall incur a third degree felony.\nAny person who unlawfully takes personal property and immediately after having committed the act uses force or intimidation against another to retain the taken item shall also incur a third degree felony.\nThe court may also impose the penalty of restitution.\nHistory —June 18, 2004, No. 149, § 198; Oct. 7, 2009, No. 117, § 1.
