Any person who is lawfully under preventive custody, imprisonment, restriction of freedom or interned as a security measure, or undergoing treatment and rehabilitation in a program of the Commonwealth of Puerto Rico or a private program, supervised and licensed by a Commonwealth agency, or under a special diversion procedure under Rule 247.1 of the Rules of Criminal Procedure, or under a special law, and escapes or evades the legal custody exercised over him/her by another person with legal authority and any other person acting jointly with same shall incur a fourth degree felony.\nThe punishment shall be imposed in addition to the punishment corresponding to the other crime or the sentenced being served.
