Rule 34

Regardless of the provisions of Rule 33, the judge presiding at the trial may admit a communication otherwise privileged if he finds that the conduct of the holder of the privilege constitutes a waiver of such privilege. History —Amended July 20, 1979, No. 180, p. 489, § 1, eff. Oct. 1, 1979.
