These rules shall take effect October 1, 1979, and shall apply to all the proceedings or actions initiated on or after such date. For such purposes, it shall be understood that a trial has begun when the oath of the first witness is given or when the first exhibit is received in evidence. If a new trial is decreed through an appeal and it is initiated on or before the effectiveness of these rules, the same shall apply in said trial, regardless of when the original proceedings were initiated.
