The provisions of §§ 3085-3092a of this title shall not cover the following acts or omissions incurred by an official, ex-official, employee or ex-employee:\n(a) When such acts or omissions constitute a crime.\n(b) When they occur outside the scope of his official functions.\n(c) When inexcusable negligence intervenes.\n(d) When a different state of law has been established jurisprudentially by a final and binding judgment.\nHistory —June 29, 1955, No. 104, p. 550, added as § 15 on Nov. 26, 1975, No. 9, p. 953, § 1; July 10, 1986, No. 113, p. 358, § 3.
