The remedy established in § 3096 of this title may be claimed by the Commonwealth of Puerto Rico within a prescriptive term of fifteen (15) years counting from the filing in record of a copy of the notice of the conviction sentence or of the guilty plea resolution referred to in § 3097 of this title. In those cases in which there is no preceding penal conviction, the term shall begin to count from the moment that the Secretary of Justice becomes aware of the damages and of the person who caused them, or from the moment that he/she could have reasonably become aware of the same.\nHistory —June 13, 2001, No. 36, § 6.
