If the mortgage does not cover the entire loan, what is provided in the preceding section shall be understood not to be prejudicial to the creditor’s ability to claim restitution for the difference against the remaining mortgaged properties that the debtor owns, but without preference, as to said difference, for those who have acquired a real right on the same properties after the mortgage was recorded.\nHistory —Mortgage Law, 1979, § 172.
