Those who have the authority in accordance with the preceding section to establish voluntary mortgages may do so themselves or through an agent.\nA mortgage granted by someone who does not have the right to do so shall not be ratified even though the grantor may later acquire this right.\nHistory —Mortgage Law, 1979, § 183.
