For the purpose of maximizing the effectiveness of this Program and of promoting the highest participation possible therein during its term of effectiveness, the Director of the OMB shall have the authority, notwithstanding any provision to the contrary, to direct and authorize, by request of and in consultation with the secretaries or heads of agency concerned, the transfer of public employees between agencies, in accordance with service needs and the fiscal situation of each agency. He/she shall also have the authority to eliminate vacant or frozen positions in the agencies, based on service needs and the fiscal situation of the agency.\nHistory —July 2, 2010, No. 70, § 19.
