(a) There is hereby established the right of every person employed in a permanent position in the Government of the Commonwealth, its agencies, instrumentalities, public corporations, or political subdivisions, but not performing the duties of such position with a temporary character, and who has left or leaves such position to enter upon active service in the Armed Forces of the United States of America, to be reinstated in his position, or in another position of like category, status and pay. Such persons shall also be entitled to such additional compensatory and other benefits as may have been provided for other positions of like category in the organization concerned. On the date of his reinstatement, the candidate’s seniority rights shall be recognized.(b) The reinstatement must be requested by the candidate within the ninety (90) days next following the date of his honorable discharge from the Armed Forces of the United States of America.(c) In case the petitioner is physically disabled to hold his former position or another of like category, status and pay, he shall be reemployed in another position for which he qualifies, and which shall be as similar as possible to the
