Any member who shall have at least ten (10) years of creditable service who shall become totally and permanently disabled because of a mental or physical condition, and as a result thereof shall be unable to discharge the duties of any assigned position in the service of the employer, shall be entitled to a non-occupational disability annuity. Retirement of the member shall occur upon his/her request or application, or upon petition of the head of his/her department or office while such member is in service, and in accordance with the rules covering disability annuities, provided in § 771 of this title.The amount of the annuity shall be one and one-half percent (1 1 / 2 %) of the average compensation, multiplied by the number of years of creditable service up to twenty (20) years, plus two percent (2%) of the average compensation multiplied by the number of years of creditable service in excess of twenty (20) years.
