The provisions of this chapter shall not apply when the Commonwealth through the corresponding authority shall determine:(a) That the total cost of any of the materials used in the construction works increases in excess of the maximum percent of preference allowed for that material as established by subsection (b) of § 4 of Act No. 103 of June 24, 1977, as amended, known as the 'Preference Procurement Act of the Government of Puerto Rico' due to the use of materials manufactured in Puerto Rico.(b) That the construction materials manufactured in Puerto Rico are not available in sufficient amounts, or are not of a satisfactory quality.
